Medically Disabled for Social Security...


The Social Security Act contains a very long definition of Disability. Put in laymen's terms, to qualify for Social Security Disability, you must

  • have a condition [illness or injury] which prevents you from working
  • have a condition which can be medically proven; that is, using generally accepted medical techniques and tests, x-rays, blood tests, EKG's, CT Scans, etc., we can show that the condition exists and impairs your ability to work
  • have a condition which has already lasted or can be reasonably expected to last for 12 continuous months or longer or can be expected to result in your death
  • have a condition which is severe enough to keep you from doing your old job AND severe enough to keep you from doing any other job you may be qualified to do by virtue of you age, education and work experience.

The condition may be either a physical limitation [bad back, heart disease, emphysema] or a psychiatric impairment [depression, anxiety].

The condition need not be related to or incurred at work.

The condition may be permanent, or may be one that will improve and allow you to return to work [after at least 12 months of disability.]
